I do not sell your personal information.
5. Lawful Bases for Processing Personal Information
UK data protection law requires a lawful basis for processing personal information.
Depending on the particular activity, I may rely on the following lawful bases:
Contract — where processing is necessary to take steps at your request before entering into a contract or to perform a contract with you. This may include using information necessary to process, personalise, produce, deliver and support your order.
Legal obligation — where processing or retention is necessary to comply with an applicable legal requirement, including relevant tax, accounting or consumer-law obligations.
Legitimate interests — where processing is reasonably necessary for a legitimate business interest and that interest is not overridden by your rights and interests. This may include protecting Artistita Studio and the website, preventing fraud, responding to certain enquiries and establishing, exercising or defending legal claims.
Consent — where I specifically request your consent and consent is the appropriate lawful basis. Where processing relies on consent, you may withdraw that consent at any time. Withdrawal does not affect processing that was lawful before consent was withdrawn.
The applicable lawful basis depends on the specific reason your information is being processed.
6. Payments
Payments made through artistita.store are processed using the payment services made available through the online store and the relevant payment provider.
The relevant payment provider may collect and process information required to authorise the transaction, process the payment and prevent fraud.
Where complete payment-card information is collected directly by the payment provider, I do not need to receive or store your complete card details.
The payment provider may process certain information as an independent controller under its own privacy terms.
7. Sharing Personal Information
I may share personal information with third parties where reasonably necessary to operate Artistita Studio, provide the website, fulfil an order or comply with legal obligations.
Depending on the services used, these may include:
* the website and ecommerce platform provider;
* payment-processing providers;
* postal, delivery and courier providers;
* email and communication service providers;
* website hosting, IT, security and technical service providers;
* professional advisers such as accountants or legal advisers where necessary; and
* regulators, courts, law-enforcement bodies or other public authorities where disclosure is required or permitted by law.
Only information reasonably necessary for the relevant purpose will be shared.
Depending on the circumstances, a third-party provider may process personal information on my behalf as a processor or may act as an independent controller for its own processing activities.
8. WhatsApp, Social Media and External Services
If you choose to contact Artistita Studio through WhatsApp or interact with Artistita Studio through a social-media platform, information you provide through that service may also be processed by the provider of the relevant platform in accordance with its own privacy terms.
The website may also contain links to third-party websites or services.
I am not responsible for the privacy practices of independent third-party websites or services that I do not control.
You should review the privacy information provided by the relevant third party where appropriate.
9. Cookies and Similar Technologies
Artistita.store may use cookies and similar technologies for purposes such as:
* providing essential website functionality;
* maintaining website and transaction security;
* enabling shopping-basket and checkout functionality;
* remembering relevant preferences; and
* where enabled and permitted, understanding website usage or providing other optional functionality.
Some cookies and similar technologies may be strictly necessary for the website or a service requested by you to operate.
Where consent is legally required for non-essential cookies or similar technologies, they will be used in accordance with your choices through the website’s cookie controls.
Where available, you can use those controls to manage or withdraw your choices.
Further information may be provided through the website’s cookie notice or cookie settings.
10. Marketing Communications
Placing an order does not automatically mean that you will be added to a marketing mailing list.
Where I provide an option to receive promotional or marketing communications and consent or another applicable permission is required, your choice will be voluntary.
Where applicable, you can unsubscribe from marketing communications using the unsubscribe option provided in the communication or by contacting me at hello@artistita.store.
Messages that are reasonably necessary to manage your order, payment, customisation, delivery or customer-service request are service communications and are separate from promotional marketing.
11. How Long I Keep Personal Information
I keep personal information only for as long as reasonably necessary for the purpose for which it was collected and for any applicable legal, tax, accounting, record-keeping, customer-service or dispute-resolution requirements.
Different categories of information may therefore be retained for different periods.
Order and transaction information may need to be retained for longer where required for tax, accounting, legal or record-keeping purposes.
Photographs, artwork and other files supplied specifically for custom or personalised work will not be retained indefinitely merely because they were provided for an order.
Such files will be retained only for as long as reasonably necessary for the relevant order and associated customer-service, business or legal purposes, unless another lawful reason requires or permits continued retention.
When personal information is no longer reasonably required, I will delete, anonymise or otherwise appropriately dispose of it where practicable.
12. International Data Transfers
Some technology, ecommerce, payment, communication or other service providers used in connection with Artistița Studio may process personal information outside the United Kingdom.
Where a restricted international transfer of personal information takes place, appropriate safeguards or another valid transfer mechanism will be relied upon where required by UK data protection law.
The specific transfer mechanism may depend on the provider and the country involved.
13. Protecting Your Personal Information
I take reasonable technical and organisational measures appropriate to the nature of the information processed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.
I also take reasonable care when selecting third-party services used to operate Artistita Studio.
However, no method of transmission over the internet or electronic storage system can be guaranteed to be completely secure.
14. Your Data Protection Rights
Under UK data protection law, you may have a number of rights concerning your personal information, depending on the circumstances.
These may include:
* the right to be informed about how your personal information is used;
* the right to request access to personal information held about you;
* the right to request correction of inaccurate or incomplete personal information;
* the right to request erasure of personal information in certain circumstances;
* the right to request restriction of processing in certain circumstances;
* the right to object to certain types of processing;
* the right to data portability where applicable;
* the right to withdraw consent at any time where processing is based on consent; and
* rights relating to certain automated decision-making, where applicable.
These rights are not absolute and their availability may depend on the circumstances and the lawful basis for processing.
To make a request concerning your personal information, contact me at hello@artistita.store.
I may ask you to provide information reasonably necessary to confirm your identity before responding to a request.
15. Complaints
If you have concerns about how your personal information has been handled, please contact me first at hello@artistita.store so that I can investigate the matter.
You also have the right to make a complaint to the Information Commissioner’s Office (ICO), the UK’s independent data protection regulator.
Further information about data protection rights and making a complaint is available directly from the ICO.
16. Children’s Privacy
Artistita Studio does not intentionally collect personal information directly from children who are not legally able to provide the relevant information, consent or enter into the relevant transaction themselves.
If you believe personal information relating to a child has been provided to me inappropriately, please contact me at hello@artistita.store so that I can assess the circumstances and take appropriate action.
17. Changes to This Privacy Policy
I may update this Privacy Policy when reasonably necessary to reflect changes to Artistita Studio, the website, services, technology providers, business practices or applicable law.
The current version will be published on this page.
Where the Policy is updated, the “Last updated” date at the top of this page will also be revised where appropriate.
