These Terms & Conditions apply to the use of artistita.store and to purchases made from Artistita Studio.

Please read these Terms & Conditions carefully before placing an order. By placing an order through this website, you agree to these terms.

1. About Artistita Studio

Artistița Studio is an independent creative business based in the United Kingdom, operated by Tita Ioana Marinela, trading as Artistita Studio.

I create and sell hand-painted clothing, personalised garments, custom artwork, printed products and other creative items. Some products are ready-made, while others are created or personalised specifically for the customer.

2. Products

I aim to describe and display my products as accurately as reasonably possible.

Because many Artistita Studio products are handmade, hand-painted or individually personalised, small variations in colour, positioning, brushwork, texture and finish may occur. These variations are part of the handmade nature of the product and do not necessarily constitute a defect.

Colours may also appear slightly different depending on screen settings, lighting, materials and the surface on which a design is applied.

Nothing in these Terms affects your statutory rights where a product is faulty, not as described or otherwise fails to meet applicable legal requirements.

3. Custom and Personalised Orders

Custom and personalised products are created according to information supplied or approved by the customer.

Depending on the product, I may ask you to provide information such as:

* artwork, logos, photographs or other image files;

* wording, names or other personalised text;

* garment size and colour;

* print or vinyl colour;

* placement preferences;

* reference images; or

* other instructions required to complete the order.

You are responsible for checking that the information you provide is accurate, including spelling, sizes, colours, quantities and personalisation details.

If required information or suitable artwork has not been provided, production may be delayed until we receive everything reasonably necessary to complete the order.

If a supplied file is unsuitable for production, we may ask you to provide a higher-quality or alternative file.

4. Customer-Supplied Artwork, Images and Files

Where you provide a logo, photograph, illustration, design, trademark or other material for use in a custom order, you confirm that you own the relevant rights or have the necessary permission to use that material and to authorise us to reproduce it for the purpose of fulfilling your order.

You remain responsible for material supplied by you.

I reserve the right to refuse material that I reasonably believe may infringe another person’s intellectual property rights, be unlawful, or otherwise be inappropriate for me to reproduce.

Providing material to me for an order does not transfer ownership of that material to Artistita Studio.

5. Original Artwork and Design Work

Where Artistita Studio creates original artwork or design work for your order, the scope of the work may be agreed with you before production begins.

Unless otherwise expressly agreed in writing, purchasing a physical product does not automatically transfer copyright or other intellectual property rights in original artwork or designs created by Artistita Studio.

You may use the purchased physical product for its normal personal or business purpose, but my original artwork or designs must not be copied, reproduced, resold as artwork, commercially exploited or used to manufacture additional products without my permission.

6. Design Approval and Changes

For certain custom orders, I may provide a digital preview, mock-up or other form of approval before production.

Where approval is requested, you are responsible for checking the design carefully before approving it, including spelling, layout, colours, placement and other personalised details.

Once a design has been approved and production has started, changes may not be possible.

If you request a change after production has begun, I will let you know whether the change can reasonably be made and whether additional costs apply before proceeding.

A digital mock-up is intended as a visual guide. Minor differences may occur between a digital representation and the finished physical product because of materials, production processes, screen display and handmade techniques.

7. Prices and Payment

Prices are displayed in the currency shown on the website.

The total price payable, including any applicable delivery charges, will be displayed before you complete your purchase.

Payment must be successfully completed through one of the payment methods available at checkout.

I will not intentionally add optional charges without your agreement.

If an obvious pricing or listing error occurs, I may contact you before accepting or fulfilling the affected order.

8. Placing an Order and Order Acceptance

When you place an order, you are responsible for checking the information entered at checkout before submitting payment.

After an order is placed, you should receive an order confirmation using the contact information supplied during checkout.

An order confirmation acknowledges that I have received your order. If I cannot accept or fulfil an order, I will contact you and, where payment has already been taken, arrange an appropriate refund.

I may decline an order where, for example, a product is unavailable, essential customisation information cannot be obtained, the requested work cannot reasonably be produced, or fulfilling the order would be unlawful.

9. Production Times

Many Artistita Studio products are made or personalised individually and therefore require production time before dispatch.

Where a production estimate is shown on a product page or otherwise communicated to you, it is an estimate unless we expressly agree a specific deadline with you.

For many custom products, my usual estimated production period is approximately 10–14 days, but this may vary depending on the product, complexity of the work, availability of materials and how quickly required information or artwork is supplied.

Production time is separate from delivery/transit time.

Where information, files or approval are required from you, the production period may not begin until I have received everything reasonably required to proceed.

If there is a significant unexpected delay, I will contact you.

10. Delivery

Available delivery methods, charges and relevant information are displayed during checkout.

You are responsible for providing a complete and accurate delivery address.

Estimated delivery times are separate from production times for made-to-order and personalised products.

Unless a different delivery period has been agreed with you, orders will be delivered within the period required by applicable consumer law.

If an order is returned to me because an incorrect or incomplete address was supplied, I may contact you to arrange redelivery and advise you of any reasonable additional delivery charge before resending the order.

Risk in the goods passes to you when the goods are delivered to you or to a person identified by you to receive them, subject to applicable consumer law.

11. Cancellation — Non-Personalised Products

For eligible products purchased online that are not made to your specifications or clearly personalised, you may have a statutory right to cancel your purchase without giving a reason.

Where the statutory cancellation right applies to goods, you generally have 14 days from the day after receiving the goods to tell me that you wish to cancel.

After notifying me of the cancellation, you generally have a further 14 days to return the goods.

Nothing in this section limits any rights you have under applicable consumer law.

12. Personalised and Bespoke Products

The statutory right to cancel for a change of mind does not generally apply to goods that are made to the consumer’s specifications or are clearly personalised, where the relevant legal exception applies.

This may include, depending on the particular order, garments or products personalised with customer-selected names, wording, artwork, logos, photographs, designs or other individually specified features.

The fact that an item is produced only after an order is placed does not, by itself, necessarily mean that the item is personalised or bespoke.

Your statutory rights remain unaffected if a personalised or bespoke product is faulty, not as described or otherwise does not conform to the contract.

13. Faulty, Damaged or Incorrect Products

If you receive an item that is faulty, damaged, incorrect or materially different from its description, please contact me as soon as reasonably possible at hello@artistita.store.

Please provide your order number and, where appropriate, photographs showing the issue so that I can investigate efficiently.

I will assess the issue and provide an appropriate remedy in accordance with your statutory consumer rights.

Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded or restricted.

14. Returns and Refunds

My Returns & Refund Policy forms part of the information governing purchases from Artistita Studio and explains our return process in greater detail.

Where there is any conflict between a store policy and a statutory consumer right that cannot legally be excluded, the applicable statutory right will prevail.

15. Intellectual Property

Unless otherwise stated, the content created by Artistita Studio and displayed on this website — including original artwork, illustrations, photographs, graphics, branding, text and original designs — belongs to Artistita Studio or is used with appropriate permission.

You must not reproduce, distribute, commercially exploit or use my original content to manufacture products without prior permission, except where such use is otherwise permitted by law.

Third-party artwork, logos or other intellectual property supplied by customers remains subject to the rights of its respective owner.

16. Website Information and Availability

I take reasonable care to keep the website and product information accurate and up to date.

I cannot guarantee that the website will always be available without interruption or that every technical error can be prevented.

I may update, modify or temporarily remove website content or products where reasonably necessary.

Nothing in this section limits liability or consumer rights where it would be unlawful to do so.

17. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded or restricted under applicable consumer law.

I am not responsible for losses that were not reasonably foreseeable when the contract was formed, subject always to rights and liabilities that cannot lawfully be excluded.

If you are purchasing as a consumer, these Terms do not affect your statutory consumer rights.

18. Privacy and Cookies

Personal information is handled in accordance with o my Privacy Policy.

Information about the cookies and similar technologies used by my website is provided through my privacy and cookie information and, where required, my cookie consent controls.

19. Changes to These Terms

I may update these Terms & Conditions from time to time, for example to reflect changes to my products, website, business practices or applicable law.

The version applicable to an order will normally be the version in effect when that order was placed.

The latest version will be published on this website with its most recent update date.

20. Governing Law

These Terms and any contract between you and Artistita Studio are governed by the applicable laws of the United Kingdom, subject to any mandatory consumer protections and jurisdiction rights that apply to you.

Nothing in these Terms removes any mandatory legal rights available to you as a consumer.
